Terms of Service

Effective October 1, 2023

Summary

In this agreement, terms such as “we”, “us”, “our”, “the operator”, and “this service” refer to Beijing Xiaoyou Network Technology Co., Ltd. (北京笑游网络技术有限公司), the developer and operator of HomeCN. Terms such as “you” and “user” refer to any natural person or single entity that downloads, installs, registers for, or otherwise uses HomeCN’s products and services — including, but not limited to, network optimization software, mobile clients, and related web pages.

By using HomeCN, you confirm that you have been informed of, and agree to, the rights and obligations described below. If you do not agree to these terms, you must not use the software.

Intellectual property

HomeCN is developed by Beijing Xiaoyou Network Technology Co., Ltd. The trademarks, copyrights, and all related material — including but not limited to text, icons, interface design, interaction design, layout structure, software data, and supporting written material — are protected by domestic and international copyright treaties and intellectual-property laws.

Software license scope

You may download HomeCN from official, lawful software platforms or app stores, install it on your mobile device, and use the service we provide.
Copying, distribution, redistribution. You may copy, distribute, and redistribute HomeCN on a non-commercial, unlimited basis, provided that every copy is complete and unaltered — including all software, electronic documentation, copyright and trademark notices, and this agreement.
Any rights to features not expressly granted here remain with the operator and are subject to the operator’s interpretation.

You must use the service in compliance with the laws of the People’s Republic of China and with this agreement. The following actions, beyond ordinary use of the software’s intended functionality, are prohibited:

No reverse engineering. You may not reverse-engineer, decompile, or disassemble HomeCN, and you may not modify any compiled resource inside the program files. This restriction applies except where the law expressly permits otherwise.
No unauthorized modification of the software, of associated resources, or of any copyright/identification text or content.
No interference with computer information systems. You may not, in violation of national regulations: delete, modify, add to, or interfere with computer-information-system functions in a way that disrupts normal operation; access or use computer information networks without authorization; modify network functions, stored data, or applications without authorization; sabotage HomeCN’s normal operation; or knowingly distribute computer viruses or other destructive programs.
No unlawful content. You may not use HomeCN to publish, copy, forward, distribute, or store content that infringes national interests or security, including content that infringes others’ intellectual property, business information, or trade secrets. You may not use HomeCN to publish illegal advertising — for example, pornography or gambling. The user is solely responsible for any consequences of such use; the operator is not responsible. Build a healthy network environment. If illegal activity is discovered, we may terminate the service and pursue legal liability. The user is fully responsible for any liability arising from unlawful use or breach of this agreement; the operator may demand compensation for damages, suspend service, retain records of the violation, and cooperate with judicial authorities.

Disclaimer of warranties

The following situations may prevent normal use of the service. Please read carefully:

Force majeure and network conditions. The service depends on a normal internet or mobile-network environment. Unstable conditions may exist due to factors beyond our control — earthquakes, floods, power outages, computer viruses, hacking, system faults, lack of network access, devices being offline or out of credit, or other communications failures. The user accepts and bears these risks; the operator is not liable.
Telecom and computer failures. The operator is not liable for losses arising from telecom-system or internet faults, computer faults or viruses, information loss or corruption, computer-system problems, or other force-majeure causes.
Third-party services. Third-party services integrated with HomeCN — for example, payment processing or SMS verification — operate under their own lawful authorization. The operator is not liable for legal disputes or losses arising from those third-party services; the third party is responsible for resolving them. The operator will cooperate with users to the extent required by law. The operator does not provide technical support or customer service for third-party software.

Other terms

Severability. If any provision of this agreement is held, in whole or in part, to be invalid or unenforceable for any reason, or to violate applicable law, that provision will be deemed removed, but the remaining provisions stay in effect and binding.
Amendments and disputes. The operator may amend this agreement to reflect changes in applicable law and regulation, or in business operations and strategy. Amendments are distributed with new versions of the software; in case of dispute, the most recent version of the agreement controls. If you do not agree to a change, you may delete the software. Continued use is treated as acceptance of the change. Disputes that cannot be resolved through negotiation will be submitted to the local court with jurisdiction over the operator’s location.
Interpretation. The operator reserves all rights of interpretation of this agreement.
